Definition: E-bike and E-chopper are hereinafter referred to as E-vehicle or E-vehicles.

1. Applicability of General Terms of Use

These General Terms of Use (see www.sure-mobility.com) apply to all agreements between Sure Mobility B.V. ("Sure") and the user ("user") for the use of electric vehicles ("e-vehicles"). These agreements are referred to as the "Use Agreement."

These Terms are an integral part of the Use Agreement.

These Terms are available on Sure's website and as a physical copy at Sure's location.

2. Condition of the E-Vehicle and Nature of Use

The user must inspect the e-vehicle upon receipt and report any defects immediately to the issuing location.

Every e-vehicle has a lock. If keys are provided, the user is responsible for them.

The user must handle the e-vehicle carefully and use it only for its intended purpose.

The e-vehicle must be returned in clean and proper condition with all provided keys.

3. Reserving an E-Vehicle

Reservations can be made via QR code or at www.sure-mobility.com.

Choose date, rental duration, time slot, and optional products (e.g., Damage Waiver).

The user must accept these General Terms of Use.

Reservations expire if not completed within 10 minutes.

Booking is confirmed via email after full payment.

No refunds for cancellations unless in emergencies (excluding service fees).

4. Use of E-Vehicle (and Passenger)

Children may ride on the back of certain e-vehicles (max 130 kg total weight).

Use is only allowed under applicable traffic laws and requirements. Non-compliance voids insurance and waivers.

Non-original chargers are prohibited. Resulting damage is the user’s responsibility.

Users must comply with all laws and local regulations.

Breach of these rules voids all damage waivers and insurance.

5. Complaints

Report complaints during use immediately to the issuing location.

If unresolved, submit in writing to Sure within 48 hours.

Only written complaints with complete info using the complaint form (NL/EN) will be processed.

6. General Liability

Use is at the user’s own risk.

Sure is not liable for loss, theft, damage, or injuries caused by user to third parties.

7. User Liability

E-vehicles cannot be lent or rented to others. Group bookings may only be used by listed participants.

The user is liable for all damage during use, regardless of who caused it. Submit damage report with ID, photos, etc.

Users are solely responsible for legal violations. Fines and penalties will be charged to the user, including €50 processing fee per offense.

8. Group Booking Liability

The main booker is jointly liable for all e-vehicles and users in the group.

Main booker ensures all group members read and understand the Terms.

The main booker is liable for all claims, damages, and thefts under the Use Agreement.

9. Damages

Damage must be reported immediately. Amount is determined using Sure’s fixed price list.

If damage can't be assessed immediately, deductible is charged pending final amount.

Damage Waiver reduces liability.

All damages must be paid immediately. Otherwise, legal costs will be claimed.

10. Accidents and Theft

Police must be contacted immediately in case of accidents, theft, fire, or wildlife damage—even minor or self-caused ones.

All details must be reported in writing to Sure and a damage form completed.

User must fully cooperate and not leave the scene until documentation is complete.

11. Third-Party Liability Insurance (W.A.)

Sure provides W.A. insurance with a €1,000 deductible per incident. Policy available online.

User is liable for deductible and any non-covered damages.

In cases of intent or gross negligence, user may be held liable beyond deductible.

12. Deductible

Standard deductible: €2,500 per e-vehicle.

This can be reduced by purchasing a Damage Waiver in advance.

13. Exceeding Usage / Not Returning / Retrieval

Use ends at agreed date and time.

Late returns: €50 per hour per vehicle, up to €2,500.

Early return: no refund. Retrieval due to user fault: minimum €100.

Payment due immediately.

In force majeure situations, arrangements will be made with Sure.

14. Cancelling a Paid Booking

No refunds are provided once a booking is paid, except in special circumstances.

15. Termination of Use Agreement

User may not cancel after reservation. Full payment remains due.

Sure may terminate the agreement without notice if the user breaches terms.

16. Alcohol / Drugs / Medication

Use of any substance impairing driving is prohibited before or during rental (alcohol, drugs, medications, etc.).

If use is suspected, Sure may deny access or retrieve the vehicle. No refund will be issued.

17. Additional Use Provisions

Stay within the designated range

No off-road use or curb impact

Avoid contact with objects

Not for beach or sandy areas

Meant for leisure and recreational use

18. Payment, Law, Jurisdiction

Late payments incur statutory interest and collection fees.

Dutch law applies exclusively.

Disputes are handled by the competent court in Sure’s or user’s district.

19. Privacy

Personal data is processed in accordance with GDPR. Privacy policy is available on Sure’s website.

20. Miscellaneous Provisions

User must provide accurate contact details and notify Sure of any changes via email.
